AI-Canada Stated Zionist Legal Network Coordinator Didn’t Compromise their Commitment to Impartiality

The following letters were exchanged between CPA and Bonnie Harnden, Executive Assistant of Amnesty International Canada in Jan./Feb 2002.
We checked recently with AI-Canada about the status of David Matas and we received the following response on Feb. 24, 2014 from Denise Glasbeek, Information Services Coordinator, Amnesty International, Canadian Section (English-Speaking):
“I don’t have an exact date for when David Matas ceased to work with Amnesty International. It was sometime close to but before 2006, I believe. To clarify, he was not employed at Amnesty International Canada. He was a volunteer with our Legal Network.” We recognize that AI-Canada has increased its engagement with and promotion of Palestinian human rights in recent years, but to our knowledge, although he is no longer involved with them, they have never distanced themselves from David Matas.
Interestingly, Matas was fully informed about the 2002 exchange of letters and even wrote about them in his outrageous 2005 “Hasbara” book “Aftershock: Anti-Zionism & Anti-Semitism

We started our engagement with AI, Canada in Jan. 2002, by inquiring about the status of David Matas and his involvement with them, and we received the following response from Bonnie Harnden.

Dear Bonnie

I was disturbed and saddened to learn that David Matas is still working with Amnesty International – Canada.
Mr. Matas is a staunch supporter and uncritical advocate of Israel and Zionism, and he is also is an apologist for Israeli injustices and atrocities against the Palestinian people.

As a “Senior Legal Counsel” to the B’nai Brith Canada, he recently wrote:

“There may be some who assert the right of return for Palestinians without any awareness of the impact it would have on the Jewish people. Others are aware but either do not care, or worse, support that impact. For those in support, ‘the right of return of the Palestinian people’ is today what the ‘final solution to the Jewish problem’ was in the days of Hitler, a mask of words disguising the end result: a denial of the Jewish people’s right to a national identity in its historic homeland.”
He also stated in the same position paper that:
“Israel has not stripped Palestinians of their nationality in violation of international law”.
And then further stated:
“The non-governmental organizations Human Rights Watch and Amnesty International have both endorsed the claimed right of Palestinians to Israel… In doing so, they have abandoned their human rights mandates and called for a human rights violation.”

This leads us to the following questions:

1- If Mr. Matas thinks that Amnesty International calls for “a human rights violation”, why is he still working with AI Canada?
2- Can a man with so much blind loyalty to Israel and the cause of Zionism be impartial?
3- After all these years of his involvement with your organization, why has AI Canada never questioned his impartiality?
4- Can we trust that the campaigns you are conducting are not politically motivated? i.e. Are the campaigns you are conducting against human rights abuses in certain Arab and Moslem countries motivated by human rights principles or by a political pro-Israeli agenda? And what guarantees can you give the public about this question when you have the likes of Mr. David Matas
working as the Coordinator for your Legal Network?

Amnesty International claims that it “is impartial. It does not take sides in political conflicts. It neither supports nor opposes any government or political system.”

If you are true to your principles, we do NOT think Mr. Matas should be involved in the work of Amnesty International in any capacity.
He not only supports a political system, but he supports a political system that denies the suffering of the Palestinian people, their inalienable rights and their HUMANITY.

David Matas is a longstanding volunteer with Amnesty International. His work with the organization has been in keeping with AI’s commitment to impartiality and independence. Mr. Matas always makes it clear when he is speaking or acting on behalf of AI and when he is doing so on behalf of other organizations. Mr. Matas has no role in developing or presenting Amnesty’s policies or actions in relation to the Middle East.

Amnesty’s work on human rights concerns in the Middle East has always been scrupulously impartial, and not influenced by political considerations. In Israel, the Occupied Territories and the Palestinian Authority the organization has spoken out frequently and very publicly with respect to human rights abuses attributable to Israeli forces, the Palestinian Authority and armed groups. Those reports are available on our website.

We in the Canada Palestine Association are outraged that David Matas, a self declared violator of Palestinian human rights, is allowed to work in Amnesty International – Canada. Human rights are universal, and a violator of human rights in one country can not be a defender of human rights anywhere else.
What is even more incomprehensible is that Matas has publicly criticized Amnesty for its support of the Palestinian right of return, accusing you of having “abandoned (your) human rights mandate”, and yet he continues to work with you and you continue to involve him in a position of trust. The principles of human rights do not lend themselves to such opportunism.

1- Mr. David Matas supports Zionism as an exclusive ideology that allows any Jew to automatically gain Israeli citizenship regardless of his/her birth place, while at the same time he vehemently denies a native of Palestine and her/his descendants the right of return to their homeland.

2- Mr. Matas DENIES the direct responsibility of the Zionist movement for the mass expulsion of the majority of the Palestinian people and the subsequent tragedy of the Palestinian dispossession. Many historians, including Israelis, have documented this direct Israeli responsibility.

“The Jewish military advantage was translated into an act of mass expulsion of more than half of the Palestinian population. The Israeli forces, apart from rare exceptions, expelled the Palestinians from every village and town they occupied. In some cases, this expulsion was accompanied by massacres as was the cases in Lydda, Ramleh, Dawimiyya, Sa’sa, Ein Zietun and other
places. Expulsion also was accompanied by rape, looting and confiscation.”

3- Mr. Matas not only defends the apartheid nature of the state of Israel, he also justifies it and believes that Israel should be the state of the Jewish people only and not of ALL its citizens. He supports the exclusive “Jewish character of the State of Israel” and “the preservation of the cultural identity of the Jewish people” in Israel.

a- On that basis, he thereby supports the ethnic cleansing of Palestinians from the state of Israel which was created according to the UN Partition Plan of Nov. 29, 1947, with a population of 50 percent Jewish and 50 percent Arab
Palestinians on 56 per cent of historic Palestine.
b- Mr. Matas believes that any natural demographic change inside Israel should be stopped by all means similar to what happened in 1947/1948.
c. He also supports all the Israeli laws and regulations that make Israel an exclusionary state and not secular for all of its citizens. The basic law, the law of return and the Jewish National Fund regulations are but a few examples.

4- Mr. Matas says the Holocaust “was global, not just European. It had a Middle East dimension, because of the failure of the states of the Middle East to offer protection to Jewish refugees”. Accordingly, he concludes that Palestinians should share in the “obligation to remedy these wrongs (of the Nazis)”, presumably by giving away their country. This is the utmost in victimizing the victim. Canada and the U.S. were two of the worst countries in turning away Jewish refugees during that period, but Mr. Matas hasn’t called for the state of Israel to be established in New York or on Vancouver Island. We refer him to the book, “The Holocaust, Victims Accuse”, published 1977 by the Orthodox Jewish group Neturei Karta, to fill the gaps in his rather selective analysis.

These are just a few examples of what David Matas stands for, and we do not understand how AI-Canada can claim that it is committed to “impartiality and independence” if it allows such a person to coordinate its legal network, and especially when this coordinator thinks that AI called for “a human rights violation” when it supported the Palestinians’ inalienable human rights.

We urge AI-Canada to:
1- Stop working with people like David Matas who call and work for violations of other peoples’ human and national rights.
2- To start a campaign to call on the Canadian government to stop the tax-deductible status of the Jewish National Fund (JNF) that discriminates on the basis of religion. The JNF and its subsidiaries control around 93 per cent of the land in Israel. This land is set aside for the exclusive use of Jews only, and the 20 per cent Muslim and Christian Israeli minority cannot buy nor even lease this land.
As a Canadian human rights organization, you do not want Canada to be an accessory to such discrimination.

In the meantime, however, we feel obliged to condemn AI-Canada and expose your hypocritical practices to all peace and human rights activists.
We will urge all those who are concerned with the universality of human rights to protest AI-Canada’s practices.

Open letter to Mayor Dianne Watts and Council Members of the City of Surrey

On Dec. 17, 2013, the Centre for Israel and Jewish Affairs (CIJA) reported that the “Mayor of Surrey Leads Trade Mission to Israel”.

CIJA then reported on Dec. 19, 2013, under the title INNOVATION IN ACTION: Surrey Trade Mission to Israel a “Game Changer”, that “The City of Surrey looks forward to hosting former Israeli Prime Minister Ehud Barak along with the former leaders of Greece and Australia as part of an international panel on global innovation (at) the city’s Surrey Regional Economic Summit on February 27th, 2014.”

We would like to draw your attention to the following facts:

1. To invite the Israeli war criminal Ehud Barak as a speaker to the “Surrey Regional Economic Summit” is outrageous and beyond belief. It is like inviting a bank thief and killer with blood on his hands to address the banking industry. We are not using the term war criminal frivolously; please refer to just a few documented examples of Barak’s terrorism and murderous past at the end of our open letter.

2. On July 9, 2005, over 170 Palestinian civil society organizations called for a broad and sustained Campaign for Boycott, Divestment and Sanctions (BDS) against Israel “until it complies with International Law and Universal Principles of Human Rights”. What the City of Surrey is now doing amounts to crossing the picket lines of the BDS Movement, a movement that represents and includes large numbers of Palestinians, Arabs, Muslims, and Canadians of diverse ethnic and religious backgrounds that reside and live in Surrey. Please do not participate in empowering Israeli war crimes, Apartheid and ethnic cleansing in violation of the Fourth Geneva Convention and the International Humanitarian Law; otherwise your involvement will make the city complicit in war crimes and crimes against humanity.

It seems to us that the city of Surrey is following on the footsteps of the Canadian Conservative Government which is making Canada and now Surrey part of Israeli Occupied Territory. Complicity in Israeli war crimes is not MORAL, and should not be perceived as a way to advance personal careers – it will not and should never be treated as such.

We ask all the Surrey Councillors to come clean and disassociate themselves from what the Mayor is doing to Surrey, a city full of diverse and dynamic communities. We hope that payback time will come at the next municipal elections for those who are complicit in violating International Humanitarian Law and putting personal interests ahead of their constituent’s needs.

Examples of Ehud Barak’s terrorism and War Crimes:

• In 1973 Ehud Barak participated in the targeted assassination of three leaders of the Palestine Liberation Organization – Abu Youssef al-Najjar, Kamal Adwan and Kamal Nasser, a Palestinian poet and PLO spokesman. According to Wikipedia he was part of the “covert mission Operation Spring of Youth in Beirut, in which he was disguised as a woman”.
• On March 11, 1978, Barak murdered an 18 year old Palestinian female prisoner Dalal al-Mughrabi in cold blood. According to the British Guardian: “Mughrabi’s body was dragged off the tarmac and shot several times by Barak in images captured by the media.”
• Ehud Barak was one of the Israeli commanders who led the Israeli death squad on April 16, 1988 that killed the beloved Palestinian leader Khalil El Wazir (Abu Jihad) in Tunis. This international terrorist attack was carried out outside of Israel in Tunisia. David Yallop, the British investigative journalist, in his book “To the Ends of the Earth” stated “This, with other elements, confirmed that the killing squad were in continuous radio contact with the Boeing flying just outside Tunisian air space. In the plane were, among others, Major General Ehud Barak, deputy to the Commander-in-Chief; Dan Shomron, Chief of Staff; Air Force Commander Avihu Bin-Nun; and the Head of Military Intelligence, Amnon Shahak.” Page 226
• From December 27, 2008 to January 18, 2009, as the Israeli Defence Minister, Barak led the Gaza massacre that resulted in the murder of around 1400 Palestinians, mostly civilians.
• On 15 September 2009, a report of the United Nations Fact Finding Mission on the Gaza Conflict was released. The report concluded that the Israel Defense Forces (IDF) had committed war crimes and possibly crimes against humanity. Following is just one example from the 574 page report, section 1732: “From the facts gathered, the Mission found that the following grave breaches of the Fourth Geneva Convention were committed by Israeli forces in Gaza: wilful killing, torture or inhuman treatment, wilfully causing great suffering or serious injury to body or health, and extensive destruction of property, not justified by military necessity and carried out unlawfully and wantonly. As grave breaches these acts give rise to individual criminal responsibility. The Mission notes that the use of human shields also constitutes a war crime under the Rome Statute of the International Criminal Court.

Note (Feb 27, 2014): The Canadian corporate media, in its usual complicit and cowardly manner, did not run one single story about the “Open Letter”, although we emailed it to all relevant media outlets in Canada.

We, in the Voice of Palestine and the Canada Palestine Association, denounce the aggressive and possibly criminal behaviour of the Canadian security accompanying PM Stephen Harper at the holy place of the Nativity church. We demand an investigation and an apology from the Canadian government; their hypocrisy has no bounds and as one Palestinian journalist stated: “You wouldn’t do this in Israel (to Israeli journalists)”.

We received the following message from Amer Hjazi, the Palestinian journalist who was roughed up by Harper’s security; some of the Canadian media did not tell the accurate story of (and tried to trivialize) what happened to this Palestinian journalist, in a real expression of “solidarity” with fellow reporters!!
Jan. 21, 2014-01-22 (Translation of the original Arabic)
On Monday morning, the Prime Minister of Canada Stephen Harper visited the Nativity Church; after the security check, only seven Palestinian journalists were allowed to cover the event and we abided by the instructions given to us by the Palestinian and Canadian security. When the Prime Minister arrived, we were allowed to take footage outside the church. When we entered the church, the Canadian security forbade us from filming in spite of the mediation of the Palestinian security. The Canadian security treated me and my colleagues roughly, and I was assaulted by one of PM Stephen Harper’s guards; I was beaten on my chest and was hurt. My colleagues stopped filming and we protested this Canadian maltreatment outside of the Nativity Church (with a work stoppage). Their behaviour was unbecoming of guests on our land; they should have shown respect for their hosts. The Palestinian Union of Journalists asked for an official apology from the Canadian Embassy, we did not receive any so far. I personally ask for an apology from the Canadian Prime Minster.
I ask you to stand in solidarity with me to regain my integrity.

Update: On Jan. 24, 2014, Amer Hjazi reported that he had been to the Canadian Embassy in Ramallah to ask for an apology, and the Embassy refused to apologize. Amer has a picture of the guard who assaulted him in his possession.

بعد أن قابلتم وزير الخارجية الكندي جون بيرد في مقر مفوضية فلسطين، أصدرت المفوضية بيانا صحفيا يتضمن النقاط التالية:

·         بهجتها باستقبال معالي الوزير جون بيرد في مقرها

·         شكر مجلس سفراء الجامعة العربية كندا لدورها الايجابي في الشرق الاوسط وشمال إفريقيا. 

·         عبر سعيد حمد عن تقديره لموقف كندا المناصر للحل الداعي لقيام دولتين، وأبدى عن تحمسه لاستقبال رئبس وزراء كندا ستيفين هاربر خلال زيارته القادمة للضفة الغربية (لاحظ لم يذكر فلسطين)

لنا الحق هنا أن نسأل “سعادة” سعيد حمد والسفراء العرب:

1-      هل تشكرون بيرد لتقديمه وحكومة كندا كل أشكال الدعم الاعمى والمطلق لإسرائيل؟ أتشكرونه لمعارضة كندا لسبعة عشر قرارا في الهيئة العامة للامم المتحدة مؤيدة للشعب الفلسطيني والعربي، كل ذلك لنصرة العدوانية والعنصرية الإسرائيلية؟

2-      هل ان تعيين الصهيونية “لليان بركوفيتشي” المعروفة بعدائها الشديد للعرب كسفيرة كندا في إسرائيل، هو من ضمن ألدور الايجابي لكندا؟ أجاب بيرد لاحد الاسئلة بقوله: “لن تكون صدمة صاعقة لاحد أن كندا هي داعما قويا لاسرائيل” أما السفيرة الجديدة فقد ادعت في مقالة لها أن ” السلطة الفلسطينية مع تقريبا كل حكومة عربية في الشرق الاوسط لا يخفوا عن التزامهم الفكري والجماعي للتدمير الكامل لاسرائيل”

3-      هل تشكرونه لقطع معونات الحكومة الكندية المادية للاتحاد الكندي العربي وللبيت الفلسطيني؟

4-      السيد حمد: هل سترحب بهاربر على اراضينا علما بانه يدعم “الصندوق القومي اليهودي”(الكيرن كييمت) العنصري، ولقبوله بأن يبنى مركز بأسمه “للثقافة والسياحة” فوق ركام القرى البدوية وعلى حساب أهلها اللذين طهروا عرقيا من قراهم؟ وهو نفس الصندوق الذي أسس “منتزه كندا” على ركام ثلاث مدن فلسطينية (يالو، بيت نوبا وعمواس)، هو أيضا نفس الصندوق الذي يمول المستوطنات غير الشرعية على أراضينا المحتلة. يبدو أنك لا تعلم او انه لا يهمك ان تعلم أن الحكومة الكندية تخصم نسبة مئوية للمتبرعين لهذا الصندوق من ضرائبهم السنوية.

السيد حمد: كان عليك أن تعرف أكثر من غيرك أن التخريب على أعمال التضامن الفلسطيني هو من المحرمات لرجل يدعي تمثيل فلسطين، لقد بدأت حركة الدعم الفلسطيني حملة لجمع التواقيع، بعد خطاب هاربر خلال العشاء للصندوق الصهيوني، لتوعية الكنديين حول تورط حكومتهم في جرائم الحرب الاسرائيلية، وقد نشرت عدة مقالات على صفحة الحملة تفضح هذا التورط. اذكر هنا بعض ما جاء في العريضة:
 كفلسطسنيين وعرب نقول للسيد هاربر “لا اهلا ولا سهلا بك فوق ارضنا المقدسة” ككنديين نقول لك “إنك لا تمثلنا” وكمناصرين أمميين للعدل والسلام في فلسطين نقول لك ” الخزي والعار عليك” توقف عن دعم سياسة دعم الفصل العنصري الإسرائيلية في هذا القرن الحادي والعشرين.

أعلن جون بيرد (وليس للمرة الآولى) خلال المؤتمر الصحفي لتعيين السفيرة الجديدة “إن حالة علاقتنا مع العالم العربي متينة، وهي تزداد قوة كل يوم.كذلك لدينا علاقات جيدة مع السلطة الفلسطينية. الظاهر أن الوزير صادق في وصفه لعلاقاته مع الأنظمة العربية الدكتاتورية وممثليهم في الخارج … إنكم في جيبته. (التفسير الوحيد الآخرهو أن معرفتكم للامور تثير الشفقة أو أنكم قاصرون.)

يحق لشعبنا بإسم أبطاله، شهدائه، أسراه، معاقيه وأيتامه الذين سرقت منهم طفولتهم أن يسألكم سيد حمد و”سعادة” السفراء العرب: أأنتم في خدمة شعبكم أم أنتم في خدمة أعداء هذا الشعب؟
